Former Prosecutor: These 7 Words Should Disqualify Pence From Holding Public Office Again

Former Vice President Mike Pence recently made it clear that he will not agree to testify before the House Select Committee investigating the January 6, 2021 attack on the U.S. Capitol that left 5 people dead.

Appearing on “Face the Nation” recently, Pence was asked by Margaret Brennan about cooperating with the committee, to which he replied:

“I never stood in the way of senior members of my team cooperating with the committee and testifying. But Congress has no right to my testimony. We have a separation of powers under the Constitution of the United States. And I believe it would establish a terrible precedent for the Congress to summon a vice president of the United States to speak about deliberations that took place at the White House.”

Those seven words, according to former federal prosecutor Glenn Kirschner, should disqualify Pence from ever holding public office again.

“Let’s be clear: By extension, Mike Pence is saying, ‘The American people have no right to my relevant testimony as Congress goes about trying to craft laws to keep this from ever happening again.'”

Kirschner added that Pence has “some of the most directly relevant evidence [as] to what happened.”

Now that Republicans have retaken control of the House of Representatives, it’s safe to predict that they will shut down the Jan. 6 committee. But their work can be transferred to the Senate, which will remain under Democratic control.

McCarthy Pledges GOP Will Read Constitution Aloud In The House – Gets Reminded Of Jan. 6

Even though it remains unclear that he will even be the next Speaker of the House, Rep. Kevin McCarthy (R-CA) is already making promises about what he and his Republican colleagues will do when they become the majority party.

On Thursday, McCarthy made an announcement on Twitter.

“On the very first day of the new Republican-led Congress, we will read every single word of the Constitution aloud from the floor of the House—something that hasn’t been done in years.”

In other words, the GOP will continue to be all about theatrics and nothing else. They have no solutions to the problems facing Americans and nothing but talking points when it comes to any domestic or foreign policy issues.

It will also be interesting to see if House Republicans read the entire Constitution, including the amendments. If they do, they’ll find this tucked away Section 3 of the 14th Amendment:

No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

January 6, 2021 was an insurrection which included a violent attack on the U.S. Capitol. And yet nearly every member of the GOP caucus has made endless excuses for ex-president Donald Trump’s role in that horrific day.

Some Republican members of Congress have also expressed their support for what transpired on Jan. 6, yet the Constitution clearly states they should not be allowed to serve.

As you would expect, Twitter couldn’t wait to remind McCarthy about the treasonous actions and words of his fellow Republicans.

Former Solicitor General Has A Way To Keep The Jan. 6 Investigation Going After GOP Takes House

The latest election returns from the still undecided Congressional races across the country suggest that Republicans will retake the House, though their margin of victory will likely be one of the smallest in history.

If indeed the House is under control of the GOP when the new Congress convenes in January, one of the first moves by the new leadership will probably be to pull the plug on the select committee investigating the January 6, 2021 attack on the U.S. Capitol.

But former acting Solicitor General Neal Katyal has a way to make sure the investigation continues, and he shared his idea on the Open Arguments podcast.

In the lame-duck session of Congress, Katyal explained, the committee can transfer their investigation to the Senate, which would then take over the investigation and preserve all of the evidence and records accumulated so far.

Today was the day that disgraced former president Donald Trump was supposed to appear before the Jan. 6 committee. He refused to do so, no doubt worried that if he testified under oath he would commit perjury and be charged with that crime.

Trump’s refusal to appear may trigger a House vote to hold the ex-president in contempt of Congress and make a referral to the Justice Department for that crime.

Trump is also facing criminal charges from the DOJ for his role in the Capitol insurrection. It remains unclear when Attorney General Merrick Garland will choose to make any announcement on a possible indictment of the former president.

Nancy Pelosi Emasculates Trump About Appearing Before Jan. 6 Committee: ‘He’s Not Man Enough’

Speaker of the House Nancy Pelosi (D-CA) cut failed, one-term former president Donald Trump to the bone on Sunday, saying he’s “not man enough” to actually appear before the House Select Committee investigating the January 6, 2021 Capitol insurrection in response to a subpoena from the committee.

During an interview with MSNBC’s Jonathan Capehart, Pelosi was first asked about Rep. Marjorie Taylor Greene’s (R-GA) remarks this week that she will be given more “power” if House Minority Leader Kevin McCarthy (R-CA) becomes Speaker after the midterm elections.

Pelosi said she remains confident that Democrats will keep control of both houses of Congress, and gave Greene the back of her hand by referring to her as “What’s-her-name.”

When asked about Trump showing up and being sworn to tell the truth before the 1/6 committee, Pelosi laughed and responded:

“I don’t think he is man enough to show up. I don’t think that his lawyers will want him to show up, because he has to testify under oath. But I don’t think he is man enough, –we will see if he is man enough to show up and the public can make their judgment.

“No one is above the law! If we believe that, then they should make a judgment about how he responds to that request.”

Reportedly, Trump has discussed testifying before the committee with his aides, but only if he’s allowed to do so on live television, according to Business Insider:

Former President Donald Trump has told aides he might comply with a subpoena to testify before the Jan. 6 committee, as long as he can do so live, The New York Times’ Maggie Haberman reported.

According to Haberman, Trump has told aides he’s not opposed to the idea of testifying before the committee, as long as it’s on his terms.

The information was a contribution by Haberman to The Times’s live coverage of Thursday’s committee hearing.

Some of his aides appear not to be enthusiastic about the idea.

Pelosi Questions Trump’s Manhood And Mocks Him For Having ‘No Courage’ – ‘He’s All Talk’

Speaker of the House Nancy Pelosi (D-CA) is making it clear that she doesn’t think failed former president Donald Trump isn’t much of a man and has “no courage” at all.

Speaking with MSNBC’s Andrea Mitchell on Tuesday, Pelosi referenced her threat to punch Trump if he dared to show up at the Capitol on January 6, 2021:

“He wouldn’t have had to courage to come to the Hill, He’s all talk.”

Footage from the Jan. 6 House Select Committee revealed Pelosi’s anger at Trump on the day the Capitol was under siege, HuffPost notes:

“I hope he comes. I’m going to punch him out. I’ve been waiting for this. For trespassing on the Capitol grounds. I’m going to punch him out. And I’m going to go to jail and I’m going to be happy.”

In response, Trump labeled Pelosi a “despicable person.”

The Speaker also told Mitchell that while she isn’t fond of having to talk about Trump, she feels a need to let the American people know what the GOP has planned if they retake control of Congress and Trump runs again in 2024:

“Our democracy is at stake when you define democracy as integrity of the vote. They want to suppress the vote. They’ve been doing that for a long time. They want to nullify the results of an election. They’re even proposing that after an election, if they don’t like the results, they will change the rules that would have governed that election retroactively. So you have to recognize that they are undermining our democracy.”

Will Trump run in 2024? Not everyone is convinced he will.

The disgraced ex-president’s former attorney, Michael Cohen, says the Donald can’t stand the thought of being a two-time loser and is making too much money from not running:

“Trump has a real problem with being called a loser. There’s something inside of him possibly because he knows that he is cannot stomach being a two-time loser. He has an incredibly fragile ego. To become a two-time loser would just destroy him. So, I do not, and I’ve always stated the same, I do not believe he’s going to run.”
