Sen. Lindsey Graham (R-GA) is under investigation for allegedly coordinating with former president Donald Trump to overturn the results of the 2020 election and commit a coup that would have allowed Trump to remain in power.
Graham is now facing charges in the state of Georgia, where an investigation is ongoing and a grand jury has been seated to indict anyone who may have broken the law in 2020, according to the Atlanta Journal-Constitution:
Prosecutors with the Fulton County District Attorney’s office, who are leading the special purpose grand jury investigation into Georgia’s 2020 election, are interested in questioning U.S. Sen. Lindsey Graham about any coordinated effort there may have been between the South Carolina Republican and officials from the Trump campaign.
More broadly, jurors and prosecutors are interested in discussing two phone conversations that Graham had with Georgia Secretary of State Brad Raffensperger and his office in the weeks following the 2020 elections, according to his subpoena.
Graham and his attorneys are claiming that he has total immunity under the Senate’s Speech and Debate Clause, which allows members of the Senate protection for any speech they engage in as part of their official duties. It remains unclear, however, how trying to overturn a valid election would be part of Graham’s duties as a senator.
Georgia prosecutors have countered Graham’s immunity claims by noting that election interference is not part of a senator’s official duties and is instead a felony.
Since the FBI served a search warrant on Trump’s Mar-a-Lago golf club on Monday, Graham has been all but frothing at the mouth in his defense of the ex-president, which has led some to suggest that the former head of state much have some sort of damaging information on the South Carolina Republican.
