A federal judge in Miami has handed down a ruling that all but guarantees failed, one-term former President Donald Trump’s lawsuit against social media companies will be squashed.
Bloomberg reports that the venue of the lawsuit has been changed, and that’s bad news for Trump and his attorneys:
Google’s legal battle to keep Donald Trump banned from the company’s YouTube video-sharing platform has been transferred from Florida to a federal court in California over objections by the former president.
The ruling Wednesday by U.S. District Judge K. Michael Moore in Miami means Trump’s lawsuit seeking a return to the social-media platform will be moved to the Northern District of California, near the headquarters of Google owner Alphabet Inc. Moore agreed with YouTube that its terms of service allow the company to choose the forum for lawsuits.
The suit against YouTube is one that Trump filed against Google — along with co-defendants Twitter and Facebook — for banning him from their platforms after he spread lies about the 2020 election being stolen from him and a mob of rioters attacked the Capitol on Jan. 6 in response to remarks the twice-impeached president made on social media.
“The Court finds that this case does not present a localized controversy that favors keeping this litigation in the Southern District of Florida,” the judge wrote. “To the contrary, this case involves issues that are national in scope.”
Trump’s lawsuit will now be heard by a court in the San Francisco Bay area, where the federal courts have more judges who were appointed by Democratic presidents.
In other words, Trump’s bogus lawsuit is doomed to fail, just as it always was. Now that it’s going to be heard by courts in California, he can count on the case being tossed out with prejudice in the near future.
