The Supreme Court Ruled Joe Biden Is Commander-In-Chief – But Three Justices Dissented

The Supreme Court ruled that President Joe Biden in indeed commander-in-chief of the U.S. armed forces, which has been true for every president in history, as clearly laid out in the Constitution.

However, the decision wasn’t unanimous, which suggests that three of the most conservative justices either think Biden isn’t commander-in-chief or haven’t bothered to read the document they swore to “preserve, protect, and defend” before they took their seat on the highest court in the country.

Vox reports that the 6-3 decision is a troubling sign that the judicial branch has become more political than ever:

The Court’s decision in Austin v. U.S. Navy SEALs 1-26 largely halted a lower court order that permitted certain sailors to defy a direct order. A group of Navy special operations personnel sought an exemption from the Pentagon’s requirement that all active duty service members get vaccinated against Covid-19, claiming that they should receive a religious exemption.

A majority of the Court effectively ruled that, yes, in fact, troops do have to follow orders, including an order to take a vaccine.

The decision is undeniably a win for the balance of power between the executive branch and the judiciary that has prevailed for many decades. But the fact that the Court had to weigh in on this at all — not to mention that three justices, Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch, dissented from the majority — is a worrisome sign about America’s judiciary.

Alito’s reasoning in his dissent is nothing short of tortured logic. According to him, members of the armed services should have the right to disobey orders handed down by their commanders, including the president of the United States, because the vaccination order didn’t provide a strong enough rationale for a religious exemption to refuse the COVID vaccine.

“In order to win at trial,” Alito wrote in response to the Navy’s warnings, “it would not be enough for the Government to posit that sending an unvaccinated Seal on such a mission might produce such consequences.” Rather, the Navy would have to prove that requiring vaccination “is the least restrictive means of furthering the interest it asserts in light of the present nature of the pandemic, what is known about the spread of the virus and the effectiveness of the vaccines, prevalent practices, and the physical characteristics of Navy Seals and others in the Special Warfare community.”

But as Vox notes, allowing one servicemember to disobey a direct order opens the proverbial barn door, which would allow every military member to do the same, and that would lead to chaos and total anarchy in the armed forces. Does that sound like it would be conducive to an orderly and strong military?

Alito’s dissent is also directly in conflict with prior decisions on matters of orders and the military:

As the Supreme Court held in Goldman v. Weinberger (1986), “the essence of military service ‘is the subordination of the desires and interests of the individual to the needs of the service.’”

Surprisingly, it was Justice Brett Kavanaugh who provided the perfect counterbalance to Alito, Thomas, and Gorsuch.

 The Constitution is very clear about who is at the top of that chain. It says, in unambiguous terms, that “the President shall be commander in chief of the Army and Navy of the United States.”

‘Angry’ US Army Vet Shreds Lauren Boebert For Her Childish Antics At SOTU Address

During Tuesday evening’s State of the Union Address, President Joe Biden brought up the issue of U.S. military veterans who have been exposed to toxic materials that are destroyed in what are known as “burn pits” on forward bases in places such as Iraq and may be responsible for the brain cancer which killed his son, Beau:

 “One of those soldiers was my son, Major Beau Biden. I don’t know for sure if the burn pit that he lived near was the cause of his brain cancer, and disease of so many other troops. But I am committed to find out everything we can.”

As the president was speaking, Colorado GOP Congresswoman Lauren Boebert stood and shouted, “13 of them!” Boebert was apparently making reference to the 13 service members who were killed in a bombing during the U.S. evacuation from Afghanistan last year.

That heckling enraged many people, including U.S. Army veteran Eileen Rivers, who excoriated Boebert in an op-ed she wrote for USA Today, noting that while we should welcome political disagreement, “there is also something wrong with reducing what should be thoughtful political discourse – done at the right time with real information – to a shameful and antagonizing heckle.”

Rivers went on to add:

“The congresswoman’s comments about a 20-year war perpetuated by leaders in both parties were misleading and lacked context. She not only lowered discourse, she disrespected the office of the presidency. I am a veteran. I spent four years of my life in the Army as an Arabic linguist. I come from a family of veterans. And I am angry.”

Most importantly, Rivers says she wants to make it clear that Lauren Boebert — who has never served a day in any branch of the military — is not the right messenger for such a message:

“When she stifled the president, she was also stifling me. Surely others who have lost loved ones felt that, too.

“Boebert does not speak for me. And neither do other members of the GOP who reinforced her sentiments on social media.”

Lauren Boebert is a pustule on the U.S. Congress. She needs to be excised by the voters in November.

Unearthed Memo Shows Trump Wanted To Turn The US Military Into His ‘Personal Goon Squad’

Failed, one-term, twice-impeached former President Donald Trump had plans to fire Secretary of Defense Mark Esper and replace him with a toady who be amenable to the idea of the U.S. military being used for the purpose of keeping Trump in power with overwhelming force.

That startling revelation is found in the new book, Betrayal, written by ABC News White House correspondent Jonathan Karl, according to Max Boot of the Washington Post:

Karl … has unearthed a memorandum from Johnny McEntee, Trump’s director of presidential personnel, listing 14 reasons for ousting Esper. That document was dated Oct. 19, 2020. Three weeks later Esper was fired by a Trump tweet.

The very premise of McEntee’s memo was both sinister and ludicrous — a 30-year-old of no professional or intellectual distinction, whose path to power was carrying Trump’s bags, was making the case for getting rid of a senior Cabinet officer for insufficient loyalty to the president. This revealing and chilling document deserves to be read not as a historical curiosity but as a terrible portent of what could be in store if Trump wins another term. He appears determined to turn the military into his personal goon squad.

Yes, you read that correctly: McEntee and Trump were planning to give Esper the boot so that the megalomaniacal ex-president could turn the military into a personal protection force, even though that was never set forth by the Founding Fathers in the Constitution.

Boot goes on to note that if Trump had such a sinister plan in place during his first administration, he would definitely try the same thing again if he happens to run for the White House a second time in 2024 and win the election:

“The next time around, Trump would want to ensure that the ‘guys with guns’ are on his side. If he wins a second term, Trump’s next defense secretary (Johnny McEntee perhaps?) would almost certainly be somebody more devoted to him than to the Constitution. For anyone concerned about the future of U.S. democracy, that should be a cause of considerable alarm at a time when Trump and Biden are running almost neck and neck in polling matchups.”

What could be more terrifying than Donald Trump having the military to use as he pleases, including against his political enemies? It’s likely he would turn the United States into a banana republic, complete with him installed as dictator for life and using the armed forces to make those who disagree with him disappear.

If indeed Trump does run again, it would be wise for every American voter to contemplate a president with unchecked power and vote to make sure that never happens. Otherwise, we’ll all be living in a country with a government reminiscent of the one that took control in Germany during the 1930s.

Trump Managed To Make His Pathetic Veterans Day Message All About Himself

Donald Trump (a.k.a. Cadet Bone Spurs) decided he’d release a message in honor of Veterans Day 2021, but he should have gone and played golf or hidden in the nearest bunker instead of issuing what turned out to be little more than a self-serving whinefest and a pathetic attempt to remain relevant a year after he lost in a landslide to President Joe Biden.

In the 38 second video, which was posted on Twitter by his spokesperson, Liz Harrington, Trump said he wanted to pay tribute to “all of those incredible people” who “serve so well and so strong and so powerfully.”

And then came the whining:

“We love you, our nation respects you, the world respects you, and we will come back. Our country has gone through a lot. The last period of time has been very, very tough, watching what you had to watch, but our country will be back and will be back stronger than ever. Happy Veterans Day.”

It’s important to keep in mind that this is the very same Donald Trump who reportedly said that Americans who fight and die for their country are nothing but “suckers” and “losers.” And yet he he loves them? The only person Trump loves is himself. That’s all a malignant narcissist like him is capable of.

Tom Cotton Gets Taken To School When He Asks Joint Chiefs Chairman Why He Hasn’t Resigned

Sen. Tom Cotton (R-AR) got a lesson in military discipline and patriotism when he attempted to suggest that Chairman of the Joint Chief of Staff, Gen. Mark Milley, should have have resigned when President Joe Biden decided to withdraw American forces from Afghanistan despite military leaders suggesting some U.S. troops should remain.

Cotton, who served in the Army, specifically asked Milley why he didn’t resign in protest when his recommendations weren’t followed. To that, the general replied:

“Senator, as a senior military officer, resigning is a really serious thing. It’s a political act if I’m resigning in protest. My job is to provide legal advice or the best military advice to the president. That’s my legal requirement. That’s what the law is. The president doesn’t have to agree with that advice. He doesn’t have to make those decisions just because we’re generals.”

Milley added that resigning just because a president doesn’t take his advice, “Would be an incredible act of political defiance for a commissioned officer to just resign.”

“This country doesn’t want generals figuring out what orders we’re going to accept and do or not. That’s not our job. It’s critical. My dad didn’t get a choice to resign at Iwo Jima. They can’t resign, so I’m not going to resign. There’s no way. If the orders are legal, we’re in a different place. If the orders are legal from civilian authority, I intend to carry them out.”

The fact that Cotton would ask such a question proves his only goal was to try and trash Biden as commander-in-chief and score political points instead of giving a damn about what’s in the long-term best interests of the United States.

If Sen. Cotton is unhappy with American foreign policy under this administration, then he should toss his hat into the 2024 presidential race and see if voters like his ideas. Otherwise, he should sit quietly and be thankful we have a president who gives a damn about our troops.
