Adam Schiff Has The Perfect Clapback When Mike Pence Refuses To Comply With A DOJ Subpoena

Former Vice President Mike Pence has decided that he will not comply with a subpoena from Special Counsel Jack Smith, who is investigating efforts by ex-president Donald Trump to overturn the results of the 2020 election.

CNN reports that Pence will say the subpoena cannot be enforced because he was president of the Senate and is therefore immune from questions about his official duties in that capacity.

Pence is expected to address the subpoena and his response to it during a trip to Iowa on Wednesday, according to a source familiar with his plans. His decision to fight the subpoena comes as the former vice president is mulling a 2024 presidential bid.

Pence has been subpoenaed by Jack Smith, the special counsel investigating Trump and his role in January 6, 2021, a source familiar with the matter told CNN. Smith’s office is seeking documents and testimony, the source said. Investigators want the former vice president to testify about his interactions with Trump leading up to the 2020 election and the day of the attack on the US Capitol.

What Pence is actually doing, however, is trying to have it both ways. He wants to pretend that he has scruples while at the same time refusing to say anything that might harm his former political patron, the disgraced former president who is running for the 2024 GOP presidential nomination. Pence is also expected to be a contender for the Republican nomination, though he has yet to announce his intentions.

Dennis Aftergut and Harvard Law Professor Laurence Tribe put Pence’s refusal to comply with the special counsel’s subpoena this way:

His purpose is transparent. It’s not to protect our legal institutions but to protect himself and his ambition to run for the White House. He knows that courts have consistently shot down claims of separation of powers and executive privilege in the context of attempts by Trump to shield his role in Jan. 6 and the events leading up to it. So Pence now makes a novel, if legally frivolous claim.


But by far the best response to what Pence is expected to do came from Rep. Adam Schiff (D-CA), who noted:

“Pence is now claiming the Speech and Debate Clause — meant for senators and members — allows him to avoid testifying about Jan 6.

“Just shows the lengths Pence will go to avoid doing his duty and telling the truth.

“What a way to launch a presidential campaign.”

WATCH Ted Cruz Go Full Hypocrite When Asked About Mike Pence Being Caught With Classified Documents

Seconds after demanding that the FBI search any property belonging to President Joe Biden for classified documents, Sen. Ted Cruz (R-TX) insisted that it was no big deal such materials had just been found at former Vice President Mike Pence’s home in Indiana.

How’s that for doing a flip-flop in the middle of blatant hypocrisy?

During an appearance on the Fox Business show “Kudlow” Tuesday, Cruz went on an extended rant aimed at Biden and his son, Hunter.

“I believe the FBI needs to search the residences of Hunter Biden and any business offices of Hunter Biden to determine if there are classified materials there, because if these classified materials in particular implicate Burisma, Ukraine, communist China, payments going to Hunter Biden or Joe Biden’s brother or the Biden family, then this shifts from a political problem to a very serious problem of criminal liability and major crimes.

“And so, the FBI needs to search the University of Delaware archives and they need to search Hunter Biden’s home and business addresses.”

But when Kudlow asked about the news that documents had been found at Pence’s home, Cruz suddenly began singing a different tune.

“Oh look, the Mike Pence story, it’s still early. You know, Mike Pence, as you noted he is a good friend, he’s a good man. He’s explained where these came from, what his office has put out is that in packing up the vice presidential offices that there were a couple of papers that were classified that were inadvertently put with non-classified materials. That was a mistake, but there’s no reason to think this was anything but inadvertent.

“That is very different from what Joe Biden has done. Joe Biden has given zero explanation how these classified documents got there. And in particular, he has given no explanation as to how he has documents from his time in the Senate.”

It’d be easy to say that Cruz is such a notorious flip-flopper that his latest contortions are to be expected. But it still needs to be pointed out, along with a reminder that Teddy is called the most hated person in the U.S. Senate.

Former Prosecutor: These 7 Words Should Disqualify Pence From Holding Public Office Again

Former Vice President Mike Pence recently made it clear that he will not agree to testify before the House Select Committee investigating the January 6, 2021 attack on the U.S. Capitol that left 5 people dead.

Appearing on “Face the Nation” recently, Pence was asked by Margaret Brennan about cooperating with the committee, to which he replied:

“I never stood in the way of senior members of my team cooperating with the committee and testifying. But Congress has no right to my testimony. We have a separation of powers under the Constitution of the United States. And I believe it would establish a terrible precedent for the Congress to summon a vice president of the United States to speak about deliberations that took place at the White House.”

Those seven words, according to former federal prosecutor Glenn Kirschner, should disqualify Pence from ever holding public office again.

“Let’s be clear: By extension, Mike Pence is saying, ‘The American people have no right to my relevant testimony as Congress goes about trying to craft laws to keep this from ever happening again.'”

Kirschner added that Pence has “some of the most directly relevant evidence [as] to what happened.”

Now that Republicans have retaken control of the House of Representatives, it’s safe to predict that they will shut down the Jan. 6 committee. But their work can be transferred to the Senate, which will remain under Democratic control.

Mike Pence Gets Shredded After Attacking Biden’s Speech About MAGA GOP Extremism

Mike Pence joined a debate he should have left alone by criticizing a speech President Joe Biden made recently in which he criticized the extreme views of the MAGA Republicans who continue to remain loyal to Donald Trump and make excuses for his every illegal action.

In case you missed it, here’s what Biden said:

“What we’re seeing now is either the beginning or the death knell of extreme MAGA philosophy. It’s not just Trump, it’s the entire philosophy that underpins the — I’m going to say something, it’s like semi-fascism.”

Pence, who is clearly trying to mend fences with the far right wing of his party that still worships Trump, took to Twitter and began slamming Biden for daring to speak the truth:

“Did you see that speech last week? President Biden held a partisan campaign rally at Independence Hall in Philadelphia, flanked by uniformed United States Marines, and revealed what’s truly at stake in the next election.”

“Never before in the history of our nation has a President stood before the American people and accused millions of his own countrymen of being a ‘threat to this country.’ To top it off, President Biden had the audacity to claim, ‘I’m asking our nation to come together, to unite.’”

Those are bold (and incredibly stupid) words coming from a man that Trump suggested might should have been hanged on January 6 to placate the rioting thugs who attacked the U.S. Capitol. As House Select Committee Vice Chair Liz Cheney noted at a hearing in June:

“Aware of the rioters chants to ‘hang Mike Pence’, the president responded with this sentiment: ‘Maybe our supporters have the right idea’. Mike Pence ‘deserves it.’”

But now Pence wants to take umbrage with Biden for calling it like he sees it and making it clear to American voters what’s at stake when they go to cast their ballots in November?

The former VP’s postings raised eyebrows and ire on social media.

Trump Was Hoping Pence And Members Of Congress Would Be ‘Killed Or Taken Hostage’ On Jan. 6: Report

Based on testimony from former Trump administration official Cassidy Hutchinson on Tuesday, it’s now clear that failed, one-term, twice-impeached former president Donald Trump wanted to see his vice president, Mike Pence, and members of Congress “killed or taken hostage” according to presidential historian Michael Beschloss.

During an appearance on MSNBC Wednesday morning, Beschloss noted:

“Everything that [Richard] Nixon did in the 1970s is put in the shade by what we have seen here. Nixon didn’t send armed terrorists up to the Capitol, and by everything that we are learning now what Donald Trump wanted to see on the 6th of January was violence. There’s every sign that he wanted to see members of Congress shot or killed or taken hostage, including his vice president, who, of course, is the president of the Senate.”

Beschloss added:

“Have we ever seen a president do 100th of that in the whole history of the United States? Historically, every other president is in one category. Donald Trump is in a category of his own.”

Consider a few more of the things Hutchinson revealed on Tuesday during her two hours of testimony, courtesy of New York magazine:

She said Trump was furious with his security officials, and she overheard him saying, “I don’t f- – -ing care that they have weapons. They’re not here to hurt me.” Later, she said that Trump wanted them to march to the Capitol after his speech.

Previous witnesses had told the January 6 committee that Trump had been saying he wanted to march to the Capitol with his supporters in the weeks leading up to the rally, but Hutchinson revealed that Trump actually tried to go as soon as he finished his speech calling on the thousands assembled before him to march there. Trump boarded a vehicle with the Secret Service, thinking he was being taken to the Capitol.

As we’ve seen many times before, Donald Trump demands loyalty from others, but will toss anyone (even family) under the bus when it suits his purposes. That’s just plain evil.
